    The old slippery slope - how do you assess who's appropriate for promotion? the one who uses PE's (performance enhancers) to achieve high results, or the one who can do it naturally? what happens if the PE user crashes in the job? Is the emplyr responsible for medical liability if they took advantage of the enhanced performance and profited? Do they share the liability if the PE user can't work at that level again? Long term disability?
