    This is why it is important to realize that targets are an important tool in order to achieve equity in the workplace. It is unrealistic to expect "Jose" or "Lakisha" to sue the company that overlooked their resume due to subconscious biases. It's only when there is a positive obligation on recruiters to improve demographic diversity will we, as a society, be able to overcome some of the subconscious biases we probably all have. I have no doubt that if the recruiters who rejected Jose had been interviewed or surveyed, they would have denied any bias against Latinos. The legal system is ill-equipped to deal with discrimination at such a deep and unconscious level.
